The person who enters the system undertakes to maintain the confidentiality of confidential information and to handle it in such a way as to ensure its protection against unauthorised disclosure, copying or use. It is authorised to make copies of any confidential information only to the extent strictly necessary and appropriate to the extent of the authorisation to enter the system. A person shall not disclose confidential information, or any part thereof, to any third party.
It shall not be considered confidential information for these purposes:
- information that becomes public knowledge without being in breach of the obligations set out herein;
- information which is exempted from the obligation of confidentiality by prior written consent;
- information of which a person is able to prove that he knew of it because he used it before it was communicated to him or he discovered it in the course of his activities;
- information which the person is obliged to disclose to third parties by virtue of an obligation imposed by generally binding legislation.
